Definitions
1.1
Competition
means the Draw where Winning Entrants will win the
Prize which includes standing a chance to be
selected to participate in the reality television
game show Tropika Island of Treasure 4.
1.2
Draw
means the random draws for the selection of winning
entrants which will occur at time intervals
determined by the promoter or, if the context
requires, any one of them.
1.3
Entrant
or you means any person who enters the Draw
to be selected to take part in the Competition.
1.4
The METRO FM contest means the contest to be
conducted by METRO FM for the selection of one
Public Contestant;
1.5
Prize
means R50 airtime voucher as well as the chance to
be selected as a Public Contestant on Tropika Island
of Treasure 4.
1.6
Promoter
means Clover S.A. (Proprietary) Limited..
1.7
Promotional Campaign
means the promotion and advertising of the
Promotional Packs before, during or after the
Competition.
1.8
Promotional Packs
means 250ml, 330ml, 500ml, 1 litre or 2 litre packs
of the Tropika range of juice blends produced by the
Promoter.
1.9
Public Contestant
means a Winning Entrant who is chosen to participate
on Tropika Island of Treasure 4 through the Draw or
by winning the METRO FM contest;
1.10
Public Contestant selection process
means the process where the Promoter chooses from
the pool of Winning Entrants who meet all the
requirements, 6 of the 7 individuals who will be
Public Contestants on Tropika Island of Treasure 4;
1.11
Tropika Island of Treasure 4
means the reality television game show where 7
celebrities and 7 Public Contestants will be chosen
by the Promoter to participate and appear on the
television show. The celebrities and Public
Contestants will compete on the television show to
win R1 million in accordance with the rules of the
show.
1.12
Winning Entrant
means an Entrant selected from the Draw to win the
Prize.
2.
Entry requirements
2.1
In order to enter the Draw you must be:
2.1.1
the purchaser of at least one of the Promotional
Packs, and will submit proof of purchase to the
Promoter on request;
2.1.2
18 (eighteen) years of age or older;
2.1.3
a South African citizen or resident;
2.2
To qualify for selection as a Public Contestant you
must meet the requirements for the Draw and must be:
2.2.1
a holder of a valid South African passport and all
other required travel documentation including, but
not limited to, a travel visa and medical
certificate, if required by the Promoter.
2.2.2
a holder of a valid South African driver’s licence
and, if required by the Promoter, a valid
international driver’s licence.
2.2.3
in good health and must be of sound body and mind,
and be willing to submit to a medical examination by
the Promoter’s chosen practitioner;
2.2.4
free from any criminal record, which the Entrant
permits the Promoter to independently confirm;
2.2.5
an able swimmer capable of comfortably swimming in
both sea and/or swimming pool environments;
2.2.6
legally able to take part in Tropika Island of
Treasure 4;
2.2.7
available for the duration of the Tropika Island of
Treasure 4 promotional campaign, being 15 October
2011 to 31 May 2012;
2.2.8
available in Johannesburg, South Africa on 14
October 2011; and
2.2.9
available to travel internationally between 14
October 2011 and 11 November 2011.; and
2.2.10
prepared to sign an agreement with the Promoter if
you are selected as a Public Contestant.
2.3
When requested to do so by the Promoter, you must
provide the Promoter with:
2.3.1
a written confirmation that you comply with each of
these Rules;
2.3.2
a recent head and shoulders colour photograph of
yourself;
2.3.3
a recent full length colour photograph of yourself;
and
2.3.4
a one (1) page motivational explanation of why you
could be a great reality television show contestant.
2.4
You must not be a director, member, partner,
employee, agent of, or a consultant to the Promoter,
nor an immediate family member, employee, business
partner and/or business associate of such director,
member, partner, employee, agent or consultant.
2.5
You must not be a distributor, retailer or otherwise
a supplier of the Tropika range of juices.
2.6
You may be contacted by the Promoter to confirm that
you do/will comply with these requirements and that
you will provide the further
information/documentation requested. If you are
contacted in this way it does not mean that you have
been selected as a Public Contestant.
2.7
A failure to provide written confirmation that you
comply with these requirements and agree to abide by
these rules can result in your being disqualified
from the Public Contestant selection process. The
Promoter reserves the right to select an alternative
Winning Entrant if you do not meet the requirements
in these rules.
3.1
You may enter the Draw by texting the following
information to 41682 (in South Africa) or by
completing the entry form on Tropika’s website (www.tropika‑island.co.za):
3.1.1
your chosen celeb’s first name;
3.1.2
your full name;
3.1.3
your age; and
3.1.4
your cellphone number and your age
3.2
Text messages will be charged at an approximate cost
of R1. Free minutes do not apply. The costs of text
messages sent by you may vary so please check with
your network operator for the current charges. You
must seek the permission of the person paying the
relevant mobile telephone bill before entering the
Competition.
3.3
The Promoter accepts no responsibility
for entries that are lost, delayed, misdirected,
damaged, or undelivered.
3.4
Incomplete, lost, misdirected, damaged, or
undelivered entries and entries that are delayed
beyond the closing date and time will be
disqualified.
3.5
The closing time and date for entries is 23:59 on 30
September 2011.
4.
The Prize
4.1
The Prize consists of two elements:
4.1.1
the chance to be selected to be a Public Contestant
on Tropika Island of
Treasure 4; and
4.1.2
R50 airtime voucher
4.2
The Prize is as stated and is not exchangeable. No
alternatives will be offered.
4.3
Entrants will be notified by the Promoter or an
agent of the Promoter that they are Winning
Entrants. It is your responsibility to ensure that
your contact details submitted by text message are
accurate.
4.4
In the event that the Promoter cannot for any reason
contact a Winning Entrant within 2 days of the Draw,
the Promoter reserves the right to draw another
Entrant instead of the Entrant initially drawn. The
Entrant initially drawn will not win the prize and
will not be considered as a possible Public
Contestant and their name and contact details shall
be removed from the pool of Entrants available for
future Draws.
4.5
Subject to these rules, the results of the Draw are
final. The Promoter will not correspond with anyone
about the results of the Draw.
4.6
The Promoter reserves the right to award the Prize
to another Entrant in the event that the Promoter
has reasonable grounds for believing that Winning
Entrant drawn has contravened any of these rules or
does not meet the requirements as set out in clause
2 of these rules.
4.7
Being a Winning Entrant does not mean that you will
be selected as a Public Contestant to participate in
Tropika Island of Treasure 4. The Competition
comprises the Draw which gives each Winning Entrant
a prize of R50 airtime voucher and an opportunity to
be selected by the Promoter to be a Public
Contestant.
4.8
If a Winning Entrant is selected as a Public
Contestant as a result of the Public Contestant
selection process they will be notified of their
selection in writing by the Promoter.
4.9
Six of the public contestants will be selected from
the Winning Entrants and the seventh public
contestant will be the winner of the METRO FM
contest. The METRO FM contest is governed by a
separate set of competition rules.
5.
Limitation of Promoter’s Liability
5.1
The Promoter will not be liable to any Entrant,
Winning Entrant or any Winning Entrant selected as a
Public Contestant, their legal representatives or
any third party for any losses, damages, costs,
claims, injuries or death in connection with their
entry into the Competition, the Draw, the
Promotional Campaign and/or the Prize.
5.1.1
This clause means that you will be entering the
Competition at your own risk and the Promoter will
not be responsible to you for any harm you suffer as
a result of your entering the Competition.
5.1.2
If you or any third party sustains any loss, injury
or death while participating in the Draw,
Competition or Promotional Campaign you will not be
able to sue the Promoter, its directors, employees
or any agents.
5.1.3
If any third party suffers harm because of your
participation in the Competition you will be
responsible to the third party and not the Promoter.
5.2
The Promoter will only be responsible for
harm or losses caused directly by the gross
negligence of the Promoter or its agents.
6.
Personal Information
Any personal information, including, without
limitation, an your name, age, address (including
post code), telephone number and/or e-mail address
will be used solely in connection with the
Promotional Campaign and/or Competition and will not
be disclosed to any third party except for the
purposes of the Promotional Campaign and/or
Competition, where applicable, unless you otherwise
consent.
7.
Governing Law
These rules are governed by and will be interpreted
in accordance with South African law and any
disputes arising out of them will be subject to the
exclusive jurisdiction of the courts of South
Africa.
